Who Governs Summerland Key?

Summerland Key is not one of Monroe County’s five incorporated municipalities (Islamorada, Key Colony Beach, Key West, Layton and Marathon). It is unincorporated, so Monroe County handles building permits, code enforcement and ROGO allocations. The county’s Land Development Code, including Chapter 138 on ROGO, governs what can be built.

ROGO on Summerland Key

New homes in unincorporated Monroe County need a ROGO allocation. The county calls ROGO a competitive system where the highest scoring applications receive building permits. Each ROGO year has four quarters. Points favor infill areas with infrastructure and penalize sensitive habitat and velocity zones. Examples from the county’s table include up to +30 for Tier III, +4 for central sewer, up to +5 for land dedication and perseverance points that accrue each year, with penalties of -6 for a V-zone structure and -4 for a CBRS unit.

The state’s Senate Bill 180 (2025) made up to 900 new allocations possible Keys-wide. The county expected to receive about 588 of them and to issue about 40 a year, with priority for owner-occupied, affordable and workforce housing and a limit of one per parcel. County staff also recommended using 62 set-aside administrative relief allocations to keep issuing permits through July 2027.

Tiers on Summerland Key

Tiers were assigned in 2005 and 2006. Tier I is environmentally sensitive land. Tier III-A is a special protection area. Tier III is infill, meaning platted subdivisions that are at least half built and have infrastructure. Tier II applies only on Big Pine Key and No Name Key, not on Summerland. Check your parcel with the county’s Tier Overlay property search.

The Land Authority Has Bought on Summerland Key

The Monroe County Comprehensive Plan Land Authority buys land for conservation, affordable housing and property-rights protection. Its January 2026 committee packet listed a contract for two Tier I lots on Summerland Key at $220,000. The same packet listed one Tier I lot on nearby Sugarloaf Key at $95,000 and a 6,000 sq ft Tier I lot on Little Torch Key at $12,500. These are individual contracts, not averages, and they show how much prices vary from lot to lot. If you own Tier I land, contacting the Land Authority (305-295-5180) is a reasonable step before you decide.

What Options Does a Tier I Owner Have?

Based on county and state sources, an owner of a Tier I lot that is unlikely to receive an allocation generally has four paths. You can offer the lot to the Land Authority or to state Florida Forever buyers. You can sell any transferable development rights (TDRs) or ROGO exemption the lot carries. You can seek administrative relief after a long period of denial, a process with its own requirements that a land use attorney can explain. Or you can sell to a private buyer, such as a neighbor or a cash buyer like us. Each path has different timing and pricing, so comparing them before you commit makes sense.

Flood Zones and Storms

New buildings must be elevated above flood levels. Under Monroe County’s ASCE 24-14 minimums, the lowest floor in Zone A must be at least base flood elevation plus 1 ft, and in V and Coastal A zones the lowest horizontal structural member must be at least base flood elevation plus 1 ft. Enclosures below base flood elevation are limited to access, limited storage and parking. Hurricane Irma made landfall on neighboring Cudjoe Key on Sept. 10, 2017 at 9:10 a.m. as a 130 mph Category 4.

What Affects the Value of Summerland Key Land

  • Tier. Tier III lots score far better in ROGO than Tier I or Tier III-A lots.
  • Waterfront. Canal and open water lots attract different buyers than inland lots.
  • Flood zone. V-zone lots lose ROGO points and cost more to build on.
  • Sewer. Central sewer earns ROGO points.
  • Allocation history. Perseverance points and prior applications matter.
  • Public buyer interest. Tier I land may draw interest from the Land Authority.
  • Title. Tax certificates, liens and heirship issues affect closing.
