About Land in Big Pine Key

Location and Jurisdiction

Big Pine Key sits at about mile marker 30 to 31 on the Overseas Highway, in the Lower Keys. Monroe County’s MOCO Report places it at MM 30.8, and the county fire station is at MM 30.5. Little Torch Key is just west at about MM 28.5, followed by Ramrod Key and Summerland Key. To the east, the Seven Mile Bridge (about MM 40 to 47) leads to Marathon. No Name Key lies just off Big Pine.

Big Pine Key is not incorporated. Monroe County handles building permits and code enforcement, and new homes compete for allocations under the county’s ROGO system. The Monroe County Tax Collector has a Big Pine Key office, open Tuesday through Thursday.

The Key Deer and the National Key Deer Refuge

The National Key Deer Refuge was established in 1957 and covers about 9,200 acres. The Key deer is listed as endangered. Because the island is Key deer habitat, development on Big Pine and No Name Key is managed under special rules that do not apply elsewhere in the Keys.

Tier II: Only on Big Pine and No Name Key

Monroe County assigned habitat tiers in 2005 and 2006. Tier I is environmentally sensitive land. Tier II is a transition or sprawl-reduction area that exists only on Big Pine Key and No Name Key. Tier III is infill. Tier III-A, the special protection designation used elsewhere, does not exist on Big Pine or No Name. You can check a parcel’s tier with the county’s Tier Overlay property search.

The Habitat Conservation Plan and What Changed in 2026

In June 2006, the US Fish and Wildlife Service approved a Habitat Conservation Plan covering about 7,000 acres on Big Pine and No Name Keys. It protects the Key deer, the Lower Keys marsh rabbit and the eastern indigo snake. The related Incidental Take Permit expired June 30, 2026.

Since July 1, 2026, permits on the two islands are reviewed through the county’s Permit Referral Process under a 2010 FEMA/NFIP Biological Opinion. According to local reports, the 3-to-1 mitigation requirement and the cumulative impact cap continue, and the maximum number of new residential units under the program rose from 200 to 236. If you are thinking about building, ask Monroe County how the Permit Referral Process applies to your lot.

ROGO Penalties on Big Pine

The county’s ROGO point table includes a -10 penalty for the Key Deer Corridor, and No Name Key also carries a penalty. By contrast, Tier III land can earn up to +30 points. That spread is why two Big Pine lots a short distance apart can have very different building prospects.

The Land Authority Focuses on Big Pine

The Monroe County Comprehensive Plan Land Authority’s 2026 Acquisition List prioritizes Tier I, II and III-A properties, especially inside the Big Pine HCP area. Its January 2026 committee packet listed a contract for a 4.23 acre Tier I parcel on Big Pine Key at $270,000, which works out to $16,875 per ROGO point, and a 6,000 sq ft Tier I lot on nearby Little Torch Key at $12,500. These are individual public purchases, not average prices. If your lot is Tier I or Tier II, it is reasonable to contact the Land Authority (1200 Truman Ave., Suite 207, Key West; 305-295-5180) and compare its answer with a private cash offer.

Flood Zones

New buildings must be elevated above flood levels. Under county minimums, the lowest floor in Zone A must be at least base flood elevation plus 1 ft, and V and Coastal A zone buildings must have the lowest horizontal structural member at least base flood elevation plus 1 ft. V-zone structures also lose 6 points in ROGO. Hurricane Irma made landfall nearby on Cudjoe Key on Sept. 10, 2017 as a 130 mph Category 4.

What Affects the Value of Big Pine Key Land

  • Tier. Tier I, Tier II and Tier III lots face very different paths to a permit.
  • Key Deer Corridor. A -10 ROGO penalty applies inside the corridor.
  • No Name Key location. No Name Key parcels also carry a ROGO penalty.
  • Habitat review. Mitigation requirements under the Permit Referral Process add cost to building.
  • Land Authority interest. Tier I and II land in the Big Pine HCP area is on the Land Authority’s priority list.
  • Flood zone and water access. Canal and open water lots attract different buyers than inland lots.
  • Acreage and access. Large tracts without road frontage are valued differently from platted lots.
  • Title and taxes. Tax certificates and heirship issues need to be cleared.

Read how to comp vacant land for the general approach. On Big Pine, a comp is only useful if it matches on tier and corridor status.

Common Big Pine Key Selling Situations

  • Tier I or Tier II lot with no clear building path. You want to compare a cash offer with the Land Authority.
  • Unsure after the 2026 change. The Incidental Take Permit expired and you want to sell rather than navigate the new review process.
  • Inherited land. A family lot or acreage tract bought decades ago. See selling inherited land.
  • Back taxes. See selling land with back taxes.
  • Landlocked acreage. See selling landlocked land.
  • Tier III lot with plans. You have a buildable lot or plans and would rather sell.
