What Happens If You Don’t Pay Your Cape Coral UEP Assessment?

What Is the Cape Coral UEP?

When Cape Coral was platted in the late 1950s and 1960s, most lots were sold without central water or sewer. Homes relied on private wells and septic tanks. To protect groundwater and the city’s canals, and to support growth, the City of Cape Coral has been extending potable water, sewer and irrigation (reclaimed water) lines into neighborhoods in phases through its Utilities Extension Project (UEP). How UEP Assessments Work

The cost of building the lines in each phase is shared among the properties that benefit from them. The city levies a special assessment on each parcel in the project area, generally based on the number of equivalent residential units (ERUs) the parcel represents. A typical single-family homesite is one unit; larger or commercial parcels may be more. The assessment is a lien on the property until it’s paid.

Owners are typically offered two ways to pay:

  • Prepayment of the full assessment, usually within a set window after the assessment is finalized.
  • Installments added to the annual property tax bill as a non-ad valorem assessment, spread over a number of years with interest.

What Happens If You Don’t Pay?

Because installments are billed on your property tax bill, not paying the UEP installment works the same way as not paying property taxes:

  1. The bill becomes delinquent if not paid by April 1 of the following year.
  2. A tax certificate is sold on the delinquent amount at the county’s annual tax certificate sale. An investor pays the amount and earns interest.
  3. Interest and fees accrue on the certificate.
  4. After two years, the certificate holder can apply for a tax deed, which can lead to the lot being sold at a public auction.

Does the UEP Balance Transfer When You Sell?

An unpaid assessment is a lien on the lot. When you sell, the remaining balance is usually either paid off at closing from your proceeds or accounted for in the price if the buyer agrees to take it on. Your title company will order a payoff and show it on the closing statement.

Does a UEP Assessment Lower Your Lot’s Value?

It’s more nuanced than that. Lots with utilities in place are often more attractive to builders, because they don’t need a well and septic system.
